1. Purpose

This Fair Usage Policy serves to define the accepted behaviour of users on the Smart4U bundles.

The Policy is intended to allow Econet Wireless to maintain.

  • i
    the integrity and quality of its Service.
  • ii
    protect its Customer/s and infrastructure from abuse;

2. System and Network security

Econet Wireless will investigate incidents involving any violation or suspected violation and shall involve and co-operate with law enforcement officials if a criminal violation is suspected. Examples of offer, system or network security violations include, without limitation, the following:

  • i.
    improper or excessive usage of the services.
  • ii.
    resale of service or offers is prohibited in the absence of agreed reseller or partner contracts and agreements.
  • iii.
    unauthorised access to systems or networks, including any attempt to probe, scan or test vulnerabilities of systems or networks without the express authorisation of Econet Wireless.
  • iv.
    forging of any TCP-IP packet header (spoofing) or any part of the header information.
  • v.
    knowingly uploading or distributing files that contain malware, including but not limited to viruses, spyware, trojan horses, worms, time bombs, cancel bots, corrupted files, root kits that may damage devices, and network systems.

3.  Actions by Econet Wireless Network

To ensure that all Customers have fair and equal use of services and to protect the integrity of the Econet Wireless, the business reserves the right, and will take whatever steps Econet Wireless deems necessary, to prevent improper or excessive usage of products and services. These steps may include but are not limited to:

  • i.
    speed throttling / limiting throughput/ Speed may be reduced after exceeding set thresholds or at varying levels.
  • ii.
    preventing or limiting Services through specific network ports or communication protocols.
  • iii.
    any action required to prevent prohibited usage (whether intended or unintended) i.e., actions to prevent the spread of viruses, worms, malicious code.
  • iv.
    complete termination of Service to Customers who grossly abuse the Econet Wireless Network and offer through improper or excessive usage.
  • v.
    suspending the Customer’s account.
  • vi.
    charging the offending customer for administrative costs incurred due to the incident.
  • vii.
    sharing information concerning the incident with law enforcement agencies.

4. Smart4U Through The Line Offer

Through the Line” means the product will be made available only to selected customers based on defined eligibility criteria, and not to the entire customer base. FUP in place depends on 3 months prior usage.

5. The bundles have got 3 usage stages namely.

  • a.
    Primary which the customer accesses at the full speed available in each area.
  • b.
    Secondary stage which has reduced speeds
  • c.
    Tertiary which has further reduced speeds
