General and Smart4U Bundles
Purpose
This Fair Usage Policy defines the accepted behaviour of users on the Smart4U bundles.
The Policy is intended to allow Econet Wireless to:
- maintain the integrity and quality of its Service; and
- protect its customers and infrastructure from abuse.
System and Network Security
Econet Wireless will investigate incidents involving any violation or suspected violation of this Policy and shall involve and cooperate with law enforcement officials if a criminal violation is suspected. Examples of offer, system, or network security violations include, without limitation, the following:
- improper or excessive usage of the services;
- resale of services or offers, where there are no agreed reseller or partner contracts and agreements in place;
- unauthorised access to systems or networks, including any attempt to probe, scan, or test vulnerabilities of systems or networks without the express authorisation of Econet Wireless;
- forging any TCP/IP packet header, including spoofing, or any part of the header information; and
- knowingly uploading or distributing files that contain malware, including, but not limited to, viruses, spyware, trojan horses, worms, time bombs, cancel bots, corrupted files, and rootkits that may damage devices and network systems.
Actions by Econet Wireless
To ensure that all customers have fair and equal use of services and to protect the integrity of the Econet Wireless network, Econet Wireless reserves the right to take whatever steps it deems necessary to prevent improper or excessive usage of its products and services. These steps may include, but are not limited to, the following:
- speed throttling or limiting throughput. Speed may be reduced after set thresholds are exceeded or at varying levels;
- preventing or limiting services through specific network ports or communication protocols;
- taking any action required to prevent prohibited usage, whether intended or unintended, including actions to prevent the spread of viruses, worms, or malicious code;
- complete termination of service to customers who grossly abuse the Econet Wireless network and offer through improper or excessive usage;
- suspending the customer’s account;
- charging the offending customer for administrative costs incurred due to the incident; and
- sharing information concerning the incident with law enforcement agencies.
Smart4U Through-the-Line Offer
“Through-the-Line” means the product will be made available only to selected customers based on defined eligibility criteria, and not to the entire customer base. The applicable Fair Usage Policy is based on the customer’s usage in the preceding three months.
